Mississauga Majors Prevail in Legal Dispute with Provincial Women’s Softball Association

Mississauga, ON - September 30, 2024 - The Mississauga Majors are pleased to announce the resolution of their legal dispute with the Provincial Women’s Softball Association (PWSA), which began in the summer of 2022. The legal matter stemmed from the Mississauga Majors' efforts to secure affiliation for two of their rep softball teams.  The PWSA denied membership to the Mississauga Majors and thus prevented REP softball teams from participating in provincial championships.

The Mississauga Majors first applied for PWSA affiliation in 2022, only to have their application denied. A second attempt in 2023 also resulted in a rejection. After pursuing all other available options, the Mississauga Majors initiated legal action against the PWSA in May 2023, arguing that they had fulfilled all the membership requirements outlined in the PWSA’s bylaws. It was further contended that the PWSA had imposed conditions on their applications that were not required of other associations seeking membership.

A hearing was held on January 22, 2024, where both the Mississauga Majors and the PWSA presented their cases. On September 20, 2024, the Honorable Justice J. Chozik delivered her decision, stating, “I find that the Majors met the criteria for association membership under the PWSA by-laws at the time of its applications. I further conclude that the PWSA did not have discretion to deny membership to the Majors when it had met the requirements for membership under the PWSA by-laws.”

Justice Chozik went on to order, “As a result, the Application is allowed. A declaration that the PWSA comply with its by-laws and an order that it grant membership to the Majors shall be issued.”

As a result of this ruling, the Mississauga Majors have been granted membership in the PWSA. The Mississauga Majors will field Rep softball teams and participate in PWSA Provincial Qualifiers and Provincial Championships for the 2025 season and beyond. The Mississauga Majors look forward to a productive and cooperative relationship with the PWSA, its board, and its members moving forward.
